All products sold by Cloud9 are intended solely for personal use by the original purchaser. Purchase of Cloud9 products does not confer any right to resell, redistribute, or otherwise transfer such products for commercial purposes without the prior express written authorization of Cloud9.

Any unauthorized resale or attempted resale of Cloud9 products shall constitute a material breach of these Terms. In such event, Cloud9 reserves the right, in its sole and absolute discretion, to:

1) Cancel, refuse, or restrict current and future orders placed by the violator, whether through the same or multiple accounts;

2) Impose a convenience and administrative fee of up to eighty percent (80%) of the total order value on any unauthorized purchase(s); and/or

3) Withhold any refund owed to the purchaser until Cloud9 has received a written undertaking, in a form satisfactory to Cloud9, that the purchaser will immediately cease and desist from all unauthorized resale activities.

Cloud9 further reserves all rights and remedies available under law and equity to protect its brand, goodwill, and distribution channels, including without limitation the right to pursue injunctive relief and damages against repeat or egregious violators.

Termination

We may terminate your access to the Service immediately, for any reason, including breach of these Terms. Provisions regarding ownership, disclaimers, indemnity, and limitations of liability shall survive termination.

Limitation of Liability

Cloud9 shall not be liable for indirect, incidental, or consequential damages, including loss of data or profits, resulting from your use of the Service.

Changes to Terms

We reserve the right to modify these Terms at any time. Your continued use of the Service constitutes acceptance of the updated Terms.
