Channel protection

How we enforce the policy.

Cloud9 monitors online marketplaces and enforces its distribution policy. If a reseller is found selling Cloud9 products on Amazon or another unauthorized marketplace:

Reseller privileges end immediately, and all pending or future orders are cancelled.
Product warranties, returns and customer support no longer apply.
Liquidated damages equal to fifty percent (50%) of the purchase value of all products resold through unauthorized channels apply.

These damages are intended to cover the administrative, investigative and reputational harm caused by unauthorized online sales, and are agreed as liquidated damages, not a penalty. Cloud9 reserves the right to take additional legal or financial action to recover losses or enforce compliance. Full terms are in the Authorized Reseller Terms sent with approval.
